ST3PR Terms and Conditions

By downloading, accessing, or using the ST3PR mobile application (the “App”), you agree to be bound by the following Terms and Conditions (the “Terms”). These Terms constitute a legally binding agreement between you (the “User,” “you,” or “your”) and ST3PR (the “Publisher,” “we,” “us,” or “our”), the developer and publisher of the App. If you do not agree to these Terms, you must not download, install, or use the App.
ST3PR is a mobile application designed to reward users with $B3TR tokens through the VeBetterDAO platform based on their daily step count, up to a maximum of 20,000 steps per day, as tracked via integration with third-party fitness tracking services (e.g., Apple Health, Google Fit). These Terms govern your use of the App, including its features, services, and integration with the VeBetterDAO decentralized application (dApp), smart contracts, and third-party NFT collections.
1. Eligibility
By using the App, you represent and warrant that:
You are at least 18 years of age or the legal age of majority in your jurisdiction.
You have the legal capacity to enter into a binding agreement.
You are not barred from using the App, receiving $B3TR tokens, or interacting with NFTs under the laws of your jurisdiction or any other applicable jurisdiction.
You will comply with all applicable laws, rules, and regulations, including those related to cryptocurrency, blockchain technology, NFTs, and fitness tracking.
You are physically capable of engaging in physical activity (e.g., walking) and have consulted a medical professional if you have any health conditions that may affect your ability to participate safely.
2. App Functionality and $B3TR Rewards
2.1 Step Tracking
The App tracks your daily step count using data from third-party fitness tracking services (e.g., Apple Health, Google Fit) integrated with your mobile device. You must grant the App permission to access your step data to participate in the reward program.
The App is designed to reward users with $B3TR tokens based on their daily step count, up to a maximum of 20,000 steps per day, as determined by the VeBetterDAO smart contracts.
We do not guarantee the accuracy of step tracking, as it relies on third-party services and your device’s sensors. Discrepancies in step counts or technical issues with third-party services are not our responsibility.
2.2 $B3TR Token Rewards
Rewards in $B3TR tokens are distributed through smart contracts on the VeBetterDAO platform, subject to the rules and conditions set by VeBetterDAO.
You acknowledge that $B3TR tokens are a cryptocurrency and their value, availability, and use may be subject to market volatility, regulatory restrictions, and the policies of the VeBetterDAO platform.
We are not responsible for the value, transferability, or usability of $B3TR tokens outside the App, nor for any losses incurred due to blockchain network issues, wallet mismanagement, or changes in VeBetterDAO’s policies.
To receive $B3TR rewards, you must have a compatible cryptocurrency wallet linked to the App and comply with VeBetterDAO’s requirements for token distribution.
2.3 NFT Multipliers
The App allows users to enhance their $B3TR rewards through multipliers associated with certain non-fungible tokens (NFTs) from third-party NFT collections available on secondary markets, such as World of V. Each NFT collection has its own specific multiplier, which may increase the $B3TR rewards earned based on your daily step count.
Third-Party NFTs: ST3PR does not create, sell, or distribute these NFTs. All NFTs used as multipliers are created and initially sold by third parties and are only available for purchase on secondary NFT marketplaces. You are solely responsible for acquiring, verifying, and maintaining ownership of any NFTs you use in connection with the App.
No Guarantee of Multiplier Availability or Value: Multipliers associated with NFT collections are subject to change at our sole discretion, including but not limited to adjustments in multiplier values, the addition or removal of eligible NFT collections, or discontinuation of the NFT multiplier feature. We are not responsible for any perceived or actual loss of value, rewards, or benefits resulting from such changes.
Royalties: Certain NFT collections may generate royalties from secondary market sales, and where we are eligible to receive such royalties, all proceeds will be used to benefit NFT holders (e.g., through enhanced features or rewards) and/or added to the VeBetterDAO reward pool for distribution to users. We make no representations or warranties regarding the amount, frequency, or distribution of royalties, which are subject to the terms of the respective NFT collections and marketplaces.
Compliance with NFT Marketplace Terms: By using NFTs in the App, you agree to comply with the terms and conditions of the NFT marketplaces (e.g., World of V) where the NFTs are purchased or traded, as well as any terms set by the original creators of the NFTs.
Risks of NFTs: You acknowledge that NFTs and their use in the App are subject to risks, including but not limited to market volatility, regulatory changes, technical issues with blockchain networks, and potential loss of access to NFTs due to wallet mismanagement or marketplace policies. We are not liable for any losses or damages arising from your acquisition, use, or inability to use NFTs in connection with the App.
VeChain Policy Changes: The use of NFTs and $B3TR rewards in the App is subject to the policies and terms of the VeChain blockchain and VeBetterDAO platform. Changes in VeChain or VeBetterDAO policies may affect the availability or functionality of NFT multipliers or $B3TR rewards, and we are not responsible for any resulting impacts.
No Endorsement: The inclusion of specific NFT collections as multipliers does not constitute an endorsement, sponsorship, or affiliation with the creators, sellers, or marketplaces of those NFTs. We do not guarantee the authenticity, legality, or value of any NFTs used in the App.
Fraud Prevention: You agree not to use fraudulent or unauthorized NFTs or engage in any activity to manipulate the NFT multiplier system. We reserve the right to verify NFT ownership and disqualify any rewards earned through fraudulent or non-compliant NFTs.
2.4 Fair Use
You agree to use the App in good faith and not to manipulate or falsify step data (e.g., through artificial means, automation, or unauthorized devices) or NFT ownership to earn rewards. Any attempt to cheat or exploit the reward system, including the NFT multiplier feature, may result in account suspension, forfeiture of rewards, or termination of your access to the App.
We reserve the right to verify step data and NFT ownership and withhold or revoke rewards if we suspect fraudulent activity or non-compliance with these Terms.
3. Account and Security
To use the App, you may need to create an account and link it to a cryptocurrency wallet compatible with VeBetterDAO.
You are responsible for maintaining the confidentiality of your account credentials (e.g., username, password, wallet private keys) and for all activities that occur under your account, including the use of NFTs.
You must immediately notify us at [insert contact email] if you suspect unauthorized access to your account, wallet, or NFTs.
We are not liable for any loss or damage resulting from unauthorized access to your account, wallet, or NFTs due to your failure to secure your credentials.
You may only create one account per individual. Duplicate accounts are prohibited and may result in suspension or termination.
4. Privacy and Data
Your use of the App is subject to our Privacy Policy, which is incorporated into these Terms by reference. Please review the Privacy Policy to understand how we collect, use, and protect your personal information, including step data and wallet information.
By using the App, you consent to the collection and processing of your step data and other personal information as described in the Privacy Policy.
You acknowledge that the App integrates with third-party services (e.g., Apple Health, Google Fit, VeBetterDAO), and your data may be subject to the privacy policies of those services.
5. Intellectual Property
The App, including its design, code, content, and branding, is owned by ST3PR or its licensors and is protected by copyright, trademark, and other intellectual property laws.
You are granted a non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes, subject to these Terms.
You may not copy, modify, distribute, reverse-engineer, or create derivative works from the App or its content without our prior written consent.
6. User Conduct
You agree not to:
Use the App for any unlawful, fraudulent, or harmful purpose.
Attempt to hack, disrupt, or interfere with the App, its servers, or the VeBetterDAO platform.
Use automated scripts, bots, or other tools to manipulate the App or its reward system.
Post or transmit any content that is defamatory, offensive, or violates the rights of others.
Misrepresent your identity or provide false information during account creation or use of the App.
7. Health and Safety
The App encourages physical activity (e.g walking, running or dancing) to earn rewards. You are solely responsible for ensuring that walking or any related activity is safe for you.
You should consult a medical professional before using the App if you have any health conditions or concerns that may affect your ability to engage in physical activity.
We are not liable for any injuries, health issues, or damages resulting from your use of the App or participation in physical activities encouraged by the App.
If you experience any discomfort, pain, or adverse symptoms while walking, you should stop immediately and seek medical advice if necessary.
8. Third-Party Services
The App integrates with third-party services, including Apple Health, Google Fit, and the VeBetterDAO platform. These services are subject to their own terms and conditions, and you agree to comply with them.
We are not responsible for the availability, accuracy, or performance of third-party services, nor for any issues arising from your use of such services.
Blockchain transactions, including the distribution of $B3TR tokens, are subject to the risks and limitations of the VeChain blockchain and VeBetterDAO platform, including network fees, delays, or failures.
9. Modifications to the App and Terms
We reserve the right to modify, suspend, or discontinue the App or any of its features at any time, with or without notice.
We may update these Terms from time to time. The updated Terms will be posted on our website or within the App, and your continued use of the App constitutes your acceptance of the updated Terms.
If you do not agree to the updated Terms, you must stop using the App immediately.
10. Termination
We may suspend or terminate your access to the App at our sole discretion, with or without notice, for reasons including but not limited to:
Violation of these Terms.
Suspected fraudulent activity or misuse of the App.
Legal or regulatory requirements.
Upon termination, your right to use the App will cease, and any unredeemed $B3TR rewards may be forfeited, subject to applicable law and VeBetterDAO’s policies.
You may terminate your account at any time by contacting us at st3pr.vet@gmail.com or following the account deletion process within the App.
11. Disclaimers
As-Is Basis: The App is provided “as is” and “as available” without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
No Guarantee of Rewards: We do not guarantee that you will earn $B3TR tokens or that the tokens will have any specific value or utility. Token rewards are subject to the rules and availability of the VeBetterDAO platform.
Technical Risks: We are not liable for any technical issues, including but not limited to app crashes, data loss, blockchain network failures, or interruptions in third-party services.
Cryptocurrency Risks: You acknowledge that $B3TR tokens are subject to market and regulatory risks, and we are not responsible for any financial losses resulting from their use or value fluctuations.
12. Limitation of Liability
To the maximum extent permitted by law:
ST3PR, its affiliates, and its licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or $B3TR tokens, arising from your use of the App.
Our total liability to you for any claim arising from these Terms or your use of the App shall not exceed $100 USD, paid in $B3TR tokens.
You assume all risks associated with the use of the App, including risks related to physical activity, cryptocurrency transactions, and third-party services.
13. Indemnification
You agree to indemnify, defend, and hold harmless ST3PR, its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, or expenses (including reasonable attorneys’ fees) arising from:
Your violation of these Terms.
Your use or misuse of the App or $B3TR rewards.
Your violation of any applicable laws or third-party rights.
Any content you submit or transmit through the App.
14. Governing Law and Dispute Resolution
Governing Law: These Terms shall be governed by and construed in accordance with the laws of Rogaland District Court, Norway, without regard to its conflict of law principles.
Arbitration: Any dispute arising out of or relating to these Terms or the App shall be resolved through binding arbitration in accordance with the rules of the Sør-Rogaland District Court. The arbitration shall take place in Stavanger, Norway, and shall be conducted in English or Norwegian. Each party shall bear its own costs and fees, except as otherwise required by law.
No Class Actions: You agree to resolve disputes on an individual basis and waive any right to participate in a class action, class arbitration, or representative action.
Exceptions: Notwithstanding the above, we may seek injunctive relief in any court of competent jurisdiction to protect our intellectual property or prevent misuse of the App.
15. App Store Policies
The App is available on the Apple App Store and Google Play Store, and your use of the App is subject to the terms and conditions of those platforms.
In the event of a conflict between these Terms and the terms of the Apple App Store or Google Play Store, the platform’s terms shall prevail with respect to your use of the App on that platform.
16. Miscellaneous
Entire Agreement: These Terms, together with the Privacy Policy, constitute the entire agreement between you and ST3PR regarding your use of the App.
Severability: If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
No Waiver: Our failure to enforce any provision of these Terms shall not constitute a waiver of that provision or any other right.
Assignment: You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign these Terms to a third party without notice to you.
Force Majeure: We shall not be liable for any delay or failure to perform due to causes beyond our reasonable control, including but not limited to acts of God, network failures, or regulatory changes.

Acknowledgment By using the ST3PR App, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions and our Privacy Policy.
